1. Data protection at a glance
General information
The following notes provide a simple overview of what happens to your personal data when you visit this website. Personal data is any data that can be used to identify you personally. For detailed information on data protection, please refer to our privacy policy set out below this text.
Data collection on this website
Who is responsible for data collection on this website?
Data on this website is processed by the website operator. Their contact details can be found in the section “Information on the controller” in this privacy policy.
How do we collect your data?
Some data is collected when you provide it to us. This may, for example, be data you enter into a contact form.
Other data is collected automatically, or after you give your consent, by our IT systems when you visit the website. This is mainly technical data (e.g. internet browser, operating system, or the time the page was accessed). This data is collected automatically as soon as you enter this website.
What do we use your data for?
Some of the data is collected to ensure the website is provided without errors. Other data may be used to analyse your user behaviour.
What rights do you have regarding your data?
You have the right, at any time, to obtain free information about the origin, recipients and purpose of your stored personal data. You also have the right to request the correction or deletion of this data. If you have given consent to data processing, you may revoke this consent at any time with effect for the future. You also have the right, under certain circumstances, to request that the processing of your personal data be restricted. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.
For this and any further questions on the subject of data protection, you can contact us at any time.
2. Hosting and content delivery networks (CDN)
We host the content of our website with the following provider:
Strato
The provider is Strato AG, Otto-Ostrowski-Straße 7, 10249 Berlin (hereinafter “Strato”). When you visit our website, Strato collects various log files including your IP addresses.
For more information, please refer to Strato’s privacy policy: https://www.strato.de/datenschutz/.
The use of Strato is based on Art. 6(1)(f) GDPR. We have a legitimate interest in the most reliable possible presentation of our website. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TTDSG (German Telecommunications and Telemedia Data Protection Act), insofar as the consent covers the storage of cookies or access to information on the user’s device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time.
Data processing agreement
We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law that ensures the processor processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.
3. General information and mandatory notices
Data protection
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.
When you use this website, various pieces of personal data are collected. Personal data is data that can be used to identify you personally. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.
Please note that data transmission over the internet (e.g. when communicating by e-mail) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.
Information on the controller
The controller responsible for data processing on this website is:
POWERJO GmbH
Holzweg 93
40789 Monheim am Rhein
Germany
Represented by: Managing Director Joachim Quantz
E-mail: quantz@powerjo.de
The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses, etc.).
Storage period
Unless a more specific storage period is stated within this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted once these reasons no longer apply.
General information on the legal bases for data processing on this website
If you have given consent to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, insofar as special categories of data under Art. 9(1) GDPR are processed. In the case of explicit consent to the transfer of personal data to third countries, data processing is also carried out on the basis of Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or access to information on your device (e.g. via device fingerprinting), data processing is additionally carried out on the basis of Section 25(1) TTDSG. Consent can be revoked at any time. If your data is required for the performance of a contract or the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data if this is necessary to fulfil a legal obligation, on the basis of Art. 6(1)(c) GDPR. Data processing may also be carried out on the basis of our legitimate interest under Art. 6(1)(f) GDPR. Information on the relevant legal basis in each individual case is provided in the following paragraphs of this privacy policy.
Information on the transfer of data to third countries not deemed safe under data protection law, and to US companies not certified under the DPF
Among other things, we use tools from companies based in third countries that are not deemed safe under data protection law, as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). If these tools are active, your personal data may be transferred to and processed in these countries. Please note that a level of data protection comparable to that in the EU cannot be guaranteed in third countries that are not deemed safe under data protection law.
Please note that the USA, as a safe third country, is generally considered to have a level of data protection comparable to that of the EU. A transfer of data to the USA is therefore permissible if the recipient holds a certification under the “EU-US Data Privacy Framework” (DPF) or has suitable additional safeguards in place. Information on transfers to third countries, including the recipients of the data, can be found in this privacy policy.
Recipients of personal data
As part of our business activities, we work with various external bodies. This sometimes requires the transfer of personal data to these external bodies. We only pass on personal data to external bodies if this is necessary for the performance of a contract, if we are legally obliged to do so (e.g. disclosure of data to tax authorities), if we have a legitimate interest in the disclosure under Art. 6(1)(f) GDPR, or if another legal basis permits the disclosure of data. When using processors, we only pass on our customers’ personal data on the basis of a valid data processing agreement. In the case of joint processing, a joint controller agreement is concluded.
Revocation of your consent to data processing
Many data processing operations are only possible with your express consent. You can revoke consent already given at any time. The lawfulness of the data processing carried out until the revocation remains unaffected by the revocation.
Right to object to the collection of data in special cases and to direct marketing (Art. 21 GDPR)
IF THE DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME, FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION, TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED, UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).
IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR SUCH MARKETING PURPOSES; THIS ALSO APPLIES TO PROFILING, INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21(2) GDPR).
Right to lodge a complaint with the competent supervisory authority
In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, place of work, or the place of the alleged breach. This right to lodge a complaint exists without prejudice to any other administrative or judicial remedy.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.
Right of access, rectification and erasure
Within the scope of the applicable statutory provisions, you have the right, at any time, to free information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, if applicable, a right to rectification or erasure of this data. For this and any further questions on the subject of personal data, you can contact us at any time.
Right to restriction of processing
You have the right to request that the processing of your personal data be restricted. You can contact us at any time to do so. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of the personal data we have stored about you, we generally need time to verify this. For the duration of this verification, you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data was/is unlawful, you may request the restriction of data processing instead of erasure.
- If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of its erasure.
- If you have lodged an objection pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or of a member state.
SSL/TLS encryption
For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the browser’s address bar changes from “http://” to “https://” and by the padlock symbol in your browser bar.
If SSL or TLS encryption is enabled, the data you transmit to us cannot be read by third parties.
4. Data collection on this website
Cookies
Our website uses what are known as “cookies”. Cookies are small data packets and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted at the end of your visit. Persistent cookies remain stored on your device until you delete them yourself or they are automatically deleted by your web browser.
Cookies may originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services provided by third-party companies within websites (e.g. cookies for processing payment services).
Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping basket function or the display of videos). Other cookies may be used to evaluate user behaviour or for advertising purposes.
Cookies that are necessary for carrying out the electronic communication process, for providing certain functions you wish to use (e.g. for the shopping basket function), or for optimising the website (e.g. cookies for measuring the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is stated. The website operator has a legitimate interest in the storage of necessary cookies for the technically error-free and optimised provision of its services. If consent has been requested for the storage of cookies and comparable recognition technologies, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and Section 25(1) TTDSG); consent can be revoked at any time.
You can set your browser so that you are informed when cookies are set, and only allow cookies on a case-by-case basis, exclude the acceptance of cookies for certain cases or in general, and enable the automatic deletion of cookies when the browser is closed. If cookies are disabled, the functionality of this website may be limited.
You can find out which cookies and services are used on this website in this privacy policy.
Consent management with Complianz
Our website uses the consent tool “Complianz” to obtain your consent to the storage of certain cookies in your browser and to the use of certain technologies, and to document this consent in line with data protection law. The provider of this technology is Complianz B.V., Kalmarweg 14-5, 9723 JG Groningen, Netherlands. Complianz runs locally on our server, so no connection to the provider’s servers is established.
On your first visit a notice appears in which you can accept all optional services, decline them or select them individually by category:
- Functional – technically necessary and always active, for example storing your cookie selection and your chosen language.
- Statistics – audience measurement with Burst Statistics on our own server.
- Marketing – HubSpot tracking, live chat and the advertising pixels of HubSpot and Meta.
Without your consent, the services in the Marketing category are not loaded. Complianz stores your selection in cookies in your browser (names beginning with “cmplz_”, storage period 365 days). You can change or withdraw your selection at any time via the “Cookie settings” link in the footer of every page. An overview of the cookies used can be found in our cookie policy.
Complianz is used to obtain the legally required consent for the use of cookies. The legal basis is Art. 6(1)(c) GDPR in conjunction with Section 25(1) TDDDG.
Server log files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- Browser type and version
- Operating system used
- Referrer URL
- Host name of the accessing computer
- Time of the server request
- IP address
This data is not combined with data from other sources.
This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of their website – the server log files must be collected for this purpose.
Enquiries by e-mail, telephone or fax
If you contact us by e-mail, telephone or fax, your enquiry, including all resulting personal data (name, enquiry), will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.
This data is processed on the basis of Art. 6(1)(b) GDPR, insofar as your enquiry relates to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), if this has been requested; consent can be revoked at any time.
The data you send us via contact enquiries remains with us until you ask us to delete it, revoke your consent to its storage, or the purpose for storing the data no longer applies (e.g. after your request has been fully processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.
HubSpot CRM
We use HubSpot CRM on this website. The provider is HubSpot Inc., 25 Street, Cambridge, MA 02141, USA (hereinafter HubSpot CRM).
Among other things, HubSpot CRM enables us to manage existing and potential customers as well as customer contacts. With the help of HubSpot CRM, we are able to record, sort and analyse customer interactions by e-mail, social media or telephone across various channels. The personal data collected in this way can be evaluated and used for communication with potential customers or for marketing measures (e.g. newsletter mailings). HubSpot CRM also enables us to record and analyse the user behaviour of our contacts on our website.
The use of HubSpot CRM is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the most efficient possible customer management and customer communication. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TTDSG, insofar as the consent covers the storage of cookies or access to information on the user’s device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time.
For details, please refer to HubSpot’s privacy policy: https://legal.hubspot.com/de/privacy-policy.
The transfer of data to the USA is based on the EU Commission’s standard contractual clauses. Details can be found here: https://www.hubspot.de/data-privacy/privacy-shield.
The company holds a certification under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information on this is available from the provider at the following link: https: //www.dataprivacyframework.gov/s/participant-search/participant- detail?contact=true&id=a2zt0000000TN8pAAG&status=Active
Data processing agreement
We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law that ensures the processor processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.
HubSpot forms and appointment booking
For contact enquiries, package enquiries, CV uploads, newsletter sign-ups and appointment bookings, we use forms and the meetings tool from HubSpot. The data you enter (e.g. name, e-mail address, company, telephone number, uploaded files, chosen appointment) is transmitted to HubSpot and stored in our HubSpot CRM in order to process your enquiry. Processing is carried out on the basis of Art. 6(1)(b) GDPR (initiation of a contract) or Art. 6(1)(a) GDPR (consent, e.g. for the newsletter). When booking an appointment, your details are additionally used for the calendar invitation and reminder. The transfer of data to the USA is based on the EU-US Data Privacy Framework and the EU standard contractual clauses. Further information: https://legal.hubspot.com/de/privacy-policy.
HubSpot tracking, live chat and advertising pixels
Only if you agree to the “Marketing” category in the cookie settings do we load the HubSpot tracking code (provider: HubSpot Ireland Ltd., 1 Sir John Rogerson’s Quay, Dublin 2, Ireland; parent company HubSpot Inc., USA). The code sets cookies (including “__hstc”, “hubspotutk”, “__hssc” and “__hssrc”) that are used to recognise returning visits and to analyse page views. If you submit a form, book an appointment or use the chat, this usage data can be linked to your contact record in our CRM.
The same code loads the live chat and the advertising pixels of HubSpot and Meta (Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, D04 X2K5, Ireland; cookie “_fbp”). The chat stores your messages with HubSpot so that we can answer your enquiry. The pixels are used to measure the effectiveness of advertisements. Data may also be transferred to servers in the USA; HubSpot and Meta are certified under the EU-US Data Privacy Framework.
The legal basis is your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TDDDG. You can withdraw your consent at any time via “Cookie settings” in the footer. Without consent, these services are not loaded.
Burst Statistics
We measure the use of our website with the WordPress plugin Burst Statistics. The plugin runs on our own server; the data is not passed on to third parties and is not merged with other data sources. In our configuration (cookieless mode) Burst does not set any cookies without your consent; visits are then only counted in pseudonymised form. If you agree to the “Statistics” category in the cookie settings, Burst may set a cookie to recognise returning visits.
The legal basis is our legitimate interest in audience measurement and in improving our website (Art. 6(1)(f) GDPR); where consent is requested, Art. 6(1)(a) GDPR and Section 25(1) TDDDG.
Language selection
Our website is multilingual. So that you return to your chosen language on your next visit, the Polylang plugin stores the cookie “pll_language” (storage period one year) in your browser. The cookie only contains the language code and is technically necessary (Section 25(2) no. 2 TDDDG, Art. 6(1)(f) GDPR).
5. Social media
This website uses elements of the LinkedIn network. The provider is LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland.
Each time a page of this website that contains LinkedIn elements is accessed, a connection is established to LinkedIn’s servers. LinkedIn is informed that you have visited this website with your IP address. If you click on LinkedIn’s “Recommend button” while logged into your LinkedIn account, LinkedIn is able to associate your visit to this website with you and your user account. Please note that, as the provider of these pages, we have no knowledge of the content of the data transmitted or its use by LinkedIn.
The use of this service is based on your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) TTDSG. Consent can be revoked at any time.
The transfer of data to the USA is based on the EU Commission’s standard contractual clauses. Details can be found here: https://www.linkedin.com/help /linkedin/answer/62538/datenubertragung-aus-der-eu-dem-ewr-und-der-schweiz?lang=de
Further information can be found in LinkedIn’s privacy policy at: https://www.linkedin.com/legal/privacy-policy.
6. Newsletter
Newsletter dispatch to existing customers
If you order goods or services from us and provide your e-mail address in doing so, we may subsequently use this e-mail address to send you newsletters, provided we inform you of this in advance. In such a case, the newsletter will only be used to send direct advertising for our own similar goods or services. You can cancel receipt of this newsletter at any time. A corresponding link can be found in every newsletter for this purpose. In this case, the legal basis for sending the newsletter is Art. 6(1)(f) GDPR in conjunction with Section 7(3) UWG (German Act Against Unfair Competition).
After you unsubscribe from the newsletter distribution list, your e-mail address may be stored by us on a blacklist to prevent future mailings to you. The data from the blacklist is used only for this purpose and is not combined with other data. This serves both your interest and our interest in complying with the statutory requirements for sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Storage on the blacklist is not time-limited. You can object to this storage if your interests outweigh our legitimate interest.
7. Plugins and tools
YouTube
This website embeds videos from the YouTube website. The operator of the website is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.
When you visit one of our pages on which YouTube is embedded, a connection is established to YouTube’s servers. This tells the YouTube server which of our pages you have visited.
Furthermore, YouTube may store various cookies on your device or use comparable recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve user-friendliness and prevent fraud attempts.
If you are logged into your YouTube account, you enable YouTube to associate your browsing behaviour directly with your personal profile. You can prevent this by logging out of your YouTube account.
The use of YouTube is in the interest of an appealing presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.
Further information on the handling of user data can be found in YouTube’s privacy policy at: https://policies.google.com/privacy?hl=de.
The company holds a certification under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information on this is available from the provider at the following link: https:/ /www.dataprivacyframework.gov/s/participant-search/participant- detail?contact=true&id=a2zt000000001L5AAI&status=Active
8. Audio and video conferencing
Data processing
For communication with our customers, we use, among other things, online conferencing tools. The specific tools we use are listed below. If you communicate with us by video or audio conference via the internet, your personal data will be collected and processed by us and by the provider of the respective conferencing tool.
The conferencing tools collect all data that you provide/use in order to use the tools (e-mail address and/or your telephone number). Furthermore, the conferencing tools process the duration of the conference, the start and end (time) of participation in the conference, the number of participants, and other “contextual information” in connection with the communication process (metadata).
Furthermore, the provider of the tool processes all technical data required to carry out the online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and the type of connection.
If content is exchanged, uploaded or otherwise provided within the tool, this content is also stored on the servers of the tool providers. Such content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared during use of the service.
Please note that we do not have full control over the data processing operations of the tools used. Our options are largely determined by the corporate policy of the respective provider. Further information on data processing by the conferencing tools can be found in the privacy policies of the respective tools used, which we have listed below this text.
Purpose and legal bases
The conferencing tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6(1)(b) GDPR). Furthermore, the use of the tools serves to generally simplify and speed up communication with us or our company (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Insofar as consent has been requested, the use of the relevant tools is based on this consent; consent can be revoked at any time with effect for the future.
Storage period
The data collected directly by us via the video and conferencing tools is deleted from our systems as soon as you ask us to delete it, revoke your consent to its storage, or the purpose for storing the data no longer applies. Stored cookies remain on your device until you delete them. Mandatory statutory retention periods remain unaffected.
We have no influence over the storage period of your data that is stored by the operators of the conferencing tools for their own purposes. For details on this, please contact the operators of the conferencing tools directly.
